SQUARE CANVAS, LLC DBA AXES & EASELS MOBILE AXE THROWING TRAILER WAIVER AND RELEASE OF LIABILITY

If you Haven’t Figured It Out Throwing Axes is Hazardous to Your Health. Serious Injury and/or Death Can Occur…PLEASE READ CAREFULLY!

Release of liability, waiver of claims, assumption of risks and indemnity agreement. By initializing and/or signing this document, you are waiving certain legal rights, including the right to sue. The individual named below (referred to as “I” or “me”) desires to participate in recreational axe throwing and axe throwing related activities (the “Activities”) using equipment (the “Equipment”) provided by SQUARE CANVAS, LLC DBA AXES & EASELS, As lawful consideration for being permitted by the Company to use the Equipment and to participate in the Activities, I agree to all the terms and conditions set forth in this agreement (this “Agreement”).

I understand that I must:

Sign a waiver.
Wear closed toe shoes.
Follow all safety instruction.
Not participate if I am under the influence of alcohol or drugs.
Not participate if I have any pre-existing injuries or medical issues that could cause harm to myself. Including but not limited to shoulder, arm, neck, or back problems;
Have a parent or guardian sign a waiver if I am under the age of 18;
Behave in a respectful manner to other guest and staff;
Accept that I can be denied service at the owners’ discretion

I AM AWARE AND UNDERSTAND THAT THE ACTIVITIES AND THE USE OF THE EQUIPMENT ARE DANGEROUS ACTIVITIES AND INVOLVE THE SIGNIFICANT RISK OF SERIOUS INJURY AND/OR PERMANENT PARALYSIS AND/OR DEATH AND/OR PROPERTY DAMAGE. SUCH RISKS MAY BE FORESEEABLE OR UNFORESEEABLE, AND MAY INCLUDE, BUT ARE NOT LIMITED TO: FAILURE OF ANY SAFETY BARRIERS OR OTHER SAFETY MEASURES, EQUIPMENT MALFUNCTION, MISS- THROWN AXES BY EMPLOYEES OR PARTICIPANTS, MISHANDLING OF THE EQUIPMENT BY EMPLOYEES OR PARTICIPANTS, AND OTHER SUCH RISKS, HAZARDS AND DANGERS THAT ARE INTEGRAL TO THE USE OF THE EQUIPMENT AND TO AXE THROWING, WHETHER IN AN INDOOR AXE THROWING FACILITY OR OUTDOORS.

I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE, INDEMNIFY AND HOLD HARMLESS SQUARE CANVAS, LLC DBA AXES & EASELS, their officers, officials, agents and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of premises used for the activity (“Releases”), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property associated with my presence or participation, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to fullest extent permitted by law.

I Agree to indemnify and hold harmless SQUARE CANVAS, LLC DBA AXES & EASELS against any and all claims, suits, or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf , including attorney’s fees and any related costs, if litigation arises pursuant to any claims made by me or by anyone else acting on my behalf. If SQUARE CANVAS, LLC DBA AXES & EASELS incurs any of these types of expenses, I agree to reimburse SQUARE CANVAS, LLC DBA AXES & EASELS.

I ACKNOWLEDGE THAT I AM VOLUNTARILY USING THE EQUIPMENT AND PARTICIPATING IN THE ACTIVITIES WITH KNOWLEDGE OF THE DANGER INVOLVED AND HEREBY AGREE TO ACCEPT AND ASSUME ANY AND ALL RISKS OF INJURY, DEATH, OR PROPERTY DAMAGE, WHETHER CAUSED BY THE NEGLIGENCE OF THE COMPANY OR OTHERWISE. To the extent that statute or case law does not prohibit releases for negligence, this release is also for negligence on the part of SQUARE CANVAS, LLC DBA AXES & EASELS its agents, and employees.

I REPRESENT THAT I AM IN GOOD HEALTH AND IN PROPER PHYSICAL AND MENTAL CONDITION TO USE THE EQUIPMENT AND PARTICIPATE IN THE ACTIVITIES. I ACKNOWLEDGE THAT ANY INJURIES THAT I SUSTAIN MAY BE COMPOUNDED BY NEGLIGENT EMERGENCY RESPONSE OR RESCUE OPERATIONS OF THE COMPANY OR OTHERS.

I agree to exercise ordinary and reasonable care at all times. I will not be impaired by the use of drugs and/or alcohol on any SQUARE CANVAS, LLC DBA AXES & EASELS premises. I acknowledge and agree that SQUARE CANVAS, LLC DBA AXES & EASELS shall not be responsible or liable for any accident, injury, theft, loss, or damage caused by my impaired judgment or negligence.

I will immediately remove myself from participation, and notify the nearest staff member if at any time I sense or observe any unusual hazard or unsafe condition, or if I feel that I have experienced any deterioration in my physical, emotional or mental fitness for continued participation.

In case of an injury, I authorize the staff of SQUARE CANVAS, LLC DBA AXES & EASELS to render first aid and I hereby authorize the SQUARE CANVAS, LLC DBA AXES & EASELS staff to act for me in case of an emergency. I agree to be financially responsible for any cost incurred as a result of such treatment. I am aware and understand that I should carry my own health insurance. I also waive and release SQUARE CANVAS, LLC DBA AXES & EASELS from any and all liability for any and all injuries and illness that occur while participating in axe throwing.

I accept full responsibility for return of all equipment in good condition or to pay replacement cost upon termination of the game. In the event that any damage to the equipment or facilities occurs as a result of me or my heirs, assigns, personal representatives and next of kin’s actions, neglect or recklessness, I acknowledge and agree to be held liable for any and all costs associated with any actions of neglect or recklessness.

I hereby grant permission to the rights of my image, likeness and sound of my voice as recorded on audio or video tape without payment or any other consideration. I understand that my image may be edited, copied, exhibited, published, or distributed and waive the right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of my image or recording.

I, the undersigned participant, affirm that I am of the age of 18 years or older, and that I am freely signing this agreement. I certify that I have read this agreement, that I fully understand its content and that this release cannot be modified orally. I am aware that this is a release of liability and THAT I AM VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE THE COMPANY. I SIGN THIS DOCUMENT VOLUNTARILY AND WITHOUT INDUCEMENT
